Interim Application has been preferred seeking recall of the order dated 9th January, 2025 dismissing the Appeal for non prosecution.

Learned Counsel appearing for the Applicant submits that on 9th January, 2025 the Advocate for the Appellant was not attending the Court and he had instructed her colleague to attend the matter however, when the matter was called out, the colleague did not attend the matter by reason of which the same came to be dismissed. 3.

For the reasons stated in the Application, the order of 9th January, 2025 is recalled. The First Appeal is restored to file. 4.

As the First Appeal is restored the interim relief which was Shubham Talle 1 of

List the First Appeal on final hearing board of 21st February, 2025.
