The Petition is filed challenging order dated 18 July 2019 passed by the Appellate Court dismissing Miscellaneous Civil Appeal No.239 of 2017 and confirming the order passed by the Trial Court on Application at Exhibit-5 on 20 November 2017. By that order the Trial Court had refused to grant temporary injunction in favour of the Petitioner/Plaintiff.

The Suit is pending since the year 2016 and there is no injunction in favour of the Plaintiff. Even the present Petition is katkam Page No.

k 2/2 12 wp 2978.20 as.doc pending since the year 2019 and has not been moved even once before this Court. There is no protection operating in favour of the Petitioner. 3.

While this Court was inclined to dismiss the Petition, Ms. Kundap would submit that the learned counsel appearing for the Petitioner is in personal difficulty.

By way of last chance, list the Petition on 22 December 2025, high on board.

It is made clear that no further request for adjournment shall be entertained.
