Heard Mr. Moray, learned Counsel appearing for the Applicant and Mr. Jain, learned Counsel appearing for the Respondent.

By the present Interim Application the Applicant is seeking extension of time to vacate the suit premises from 31st January 2025 as granted by the order dated 14th January 2025 by further period of two weeks.

It is the submission of Mr. Moray, learned Counsel appearing for the Applicant that the possession was not handed over Sonali

501-IA-1310-2025.DOC immediately after passing of the order on 14th January 2025 and the possession was handed over to the Respondent on 28th January 2025. Although the prayer is made to grant extension for a period of two weeks, however, time to vacate as granted by the order dated 14th January 2025 is extended till 9th February 2025. 4.

Mr. Moray, learned Counsel appearing for the Applicant, on the instructions of the Applicant, states that the Applicant will vacate the suit premises on 9th February 2025 on or before 03:00 p.m. The said statement is accepted as undertaking given to this Court.

It is clarified that the order dated 14th January 2025 is modified to the above extent only.

Accordingly, the Interim Application is disposed of in above terms with no order as to costs.
