Mr. Chandrakant Chavan, Advocate for Respondent No.3. CORAM : RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.
DATE : 4th FEBRUARY, 2025 P. C.
1.
This Interim Application is filed by the Petitioner for amending the Petition in light of the subsequent events that have occurred after the passing of the interim order of this Court, dated 14th November, 2024.
2.
The Hon'ble Supreme Court has recorded the request of the Petitioner, to request the High Court to decide the Writ Petition expeditiously. The Hon'ble Supreme Court has observed in its order dated 12th December, 2024 as under:
"We are inclined to accept the aforesaid prayer and dispose of the present special leave petition observing that the interim order passed by this court will be treated as modified in terms of the present order. It is, however, clarified that the interim order passed by this court has not been vacated. The order of this court, however, shall not be treated as final and binding, as the issue in question is sub judice before the High court."
As such, the Hon'ble Supreme Court accepted the request of the Petitioner for an expeditious hearing.
3.
The learned Advocate appearing for the Union of India submits that the Hon'ble Supreme Court has not given any timeline to this Court and there is no order which directs this Court to decide the Writ Petition within a time-frame. He, therefore, prays for four weeks time to file a reply to the Civil Application seeking amendment. 4.
We find that the said request on behalf of the Union of India
for four weeks time, is not justified. We, therefore, direct that the Affidavit-in-Reply to the Interim Application be filed on or before 18th February, 2025.
6.
List this Interim Application on 28th February, 2025, in the urgent orders category.
