Interim application is filed for clarification of order dated 9 December 2025 with a prayer to strike down paragraph 4. 2.

Though paragraph 4 was dictated on an agreement made by both the learned counsel, the applicant today states that there are other points involved in the appeal and therefore this paragraph has been wrongly dictated. This order was dictated in the open Court and it is clearly recorded that it was agreed upon by both counsel. Today, no affidavit is filed by counsel who made statements and whose statements by RAJESHWARI SUBODH KARVE Date:

2026.03.17 14:33:50 +0530 RAJESHWARI SUBODH KARVE are recorded. Therefore, this type of application is highly uncalled for moreso when the order is dictated in the open Court in the presence of counsel and after recording the agreement of the counsel.

Paragraph 4 gave liberty to the parties to move the Court for early hearing in the month of January. This was in favour of the appellant but however today because of the conduct of the appellant, paragraph 4 is deleted and Registrar is directed not to give any preference to this appeal at any cost. The appeal should come up for hearing in its regular course.
