1) This is an Application for restoration of Writ Petition No. 13583 of 2023, which was dismissed by a self imperative Order dated 7th October 2024.
1.1) There is a delay of 74 days in preferring present Application. 2) Perusal of Application indicates that, no plausible explanation is offered for condonation of the said delay by the Petitioner. However at the profuse request of the learned Advocate for the Applicant and on his statement that, for condonation of the said delay, the Applicant will pay a 1/2
dtg 18-Ia-2066-2025.doc cost of Rs. 5,000/- to Kirtikar Law Library, High Court, Mumbai, within a period of two weeks from the date of uploading of the present Order on the official website of the High Court of Bombay. The said statement is accepted. 3) Subject to payment of aforesaid cost within stipulated period as noted above, delay is condoned and Application is allowed in terms of prayer clause (a).
4) Applicant/Petitioner is directed to supply spare copies of the Petition in the Registry within a period of two weeks from the date of payment of cost to the said Library.
