For the reasons mentioned in the interim application, the application is allowed in terms of prayer clause (a). 2.

The application is allowed so far as petitioner No.1 is concerned. The writ petition, to that extent, stands disposed of. However, in relation to petitioner No.2, it will be open for the society to recover the amount of loss from petitioner No.2 in accordance with law.

The learned Advocate appearing for the petitioners, on

909-ia2108-2026 with wp-6397-2023 Final.doc instructions, states that the petitioner will deposit an amount of Rs. 7 lakhs in this Court within a period of six weeks from today. This statement is accepted and treated as an undertaking given to the Court.

Upon deposit of the said amount, the ad interim relief earlier granted by this Court shall continue to operate until further orders. 5.

The matter is now kept on 9 June 2026.

It is clarified that if petitioner No.1 fails to deposit the said amount within the stipulated period, the interim order shall automatically stand vacated without any further reference to the Court. In such a situation, it will be open for the society to recover the amount by initiating proceedings, in accordance with law. (AMIT BORKAR, J.)
