Heard the learned Counsel for the parties.

This is an application for condonation of 43 days delay in preferring the Second Appeal against the judgment and decree dated 9 September 2024 passed by the learned District Judge in Regular Civil Appeal No.24 of 2024. 3.

In paragraph No.10 to 13, the applicant has ascribed reasons for not preferring the appeal within the stipulated period. 4.

Having regard to the reasons assigned in the application and to advance the cause of substantive justice, delay of 43 days which does not seem to be inordinate, deserves to be condoned. 5.

Hence, the Interim Application stands allowed in terms of prayer clause (b).
