The Applicant-Mother is seeking following reliefs in the Interim Application :

"(a) that, the Application be allowed (b) that this Hon'ble Court be pleased to direct the Registry of this Hon'ble Court to release the USA passport of Ayush which is currently in the custody of the Registrar of this Hon'ble Court;

(c ) that, this Hon'ble court be pleased to allow Ayush to travel to Abu Dhabi and Dubai from 15/03/2025 to 19/03/2025 (both days inclusive) during Ayush's Spring break;

(d) that, this Hon'ble Court be pleased to allow Ayush to travel to USA for the Robotics International Competition (in the event his team qualifies for the same) from 16/04/2025 to 19/04/2025 in (USA) + travel time;

(e) that, this Hon'ble Court be pleased to allow Ayush to travel to USA to meet his sister Anshita during his summer holidays in June 2024."

This Interim Application was heard on 5th March 2025. On that date, Ms. Daruwala, learned Counsel for the Applicant submitted that as far as prayer clause (d) is concerned, Team of which Ayush was part has not qualified to participate in the Robotics International Competition and therefore, she is not pressing prayer clause (d). As far as prayer clause (c) is concerned, when this Court started dictating the Order on 5th March 2025 and dictated the order partly, at that stage, Mr. Dushyant Purekar, learned Counsel for the Respondent-Father submitted that the access for few days of Ayush was not given to the Respondent and accordingly oral direction was given to give said access and therefore the Interim Application is placed today for passing further Order.

Learned Counsel for the Applicant states that the said oral direction has been complied with. She further states that the compensatory access will be given on 13th March 2025 between 8.00 p.m. to 10.00 p.m.

Today Advocate, Mr. Navin Sharma appears for the Respondent.

Both the learned Counsel tenders Minutes of Order. The Minutes of Order are signed by both the learned Advocates as well as by the Respondent- Deepak Lalitprasad Pant, who is personally present in the Court.

Accordingly, said Minutes of Order are taken on record and marked "X" for identification. The said Minutes of Order reads as under:

"MINUTES OF ORDER 1.

Parties have agreed that the Petitioner, along with the minor son, Ayush, shall travel to Dubai and Abu Dhabi from 15.03.2025 to 19.03.2025 (both days inclusive) during Ayush's Spring break from School.

The Petitioner agrees to deposit Rs. 75,00,000/- with the Registry of this Hon'ble Court by way of a Demand Draft in the name of the Registrar of this Hon'ble Court which will be valid for a period of three months and, accordingly, the Petitioner is allowed to withdraw Ayush's Passport, which is deposited with the Registry of this Hon'ble Court for Ayush's travel to Dubai and Abu Dhabi.

On Ayush's return from Dubai and Abu Dhabi to Mumbai, India on 20.03.2025, the Petitioner shali collect / withdraw the Demand Draft of Rs. 75,00,000/- (Rupees seventy five lakhs only) from the Registry of this Hon'ble Court and re-deposit Ayush's Passport with the Registry of this Hon'ble Court.

That on return from the holiday on 19.03.2025, the Applicant shall continue working at the Mumbai Office of her employer Abbot Healthcare Pvt. Ltd. 7.

Accordingly, the Interim Application No.3128 of 2025 is disposed of in terms of Minutes of Order, however, with no order as to costs.
