There is a delay of 76 days in preferring the Appeal. The Respondent Nos.1 to 3/Defendants are duly served. There are two Affidavits which are filed. It is recorded in the order dated 23rd September 2025. No one has appeared.

For the reasons stated in the Application, the Application is allowed in terms of prayer clause (a). It is disposed of. FIRST APPEAL (ST) NO.1024 OF 2025 4.

Issue notice to the Respondents. Private notice, in addition, is allowed. Affidavit of service be filed. Compilation of documents be filed.

In the first line of paragraph No.2 of the order dated 23rd September 2025, the word 'not' be added in between the word 'has and been'.
