By this application, the applicant has prayed for condonation of delay of 35 days in filing the present application and for setting aside the order of abatement, if any, as well as for bringing on record the legal heir of the deceased petitioner as per the schedule attached to the application. 3.

Having perused the averments as made in the interim application, delay is sufficiently explained, hence, condoned. It is in the interest of justice that the application is allowed.

Interim Application is accordingly allowed in terms of prayer clauses (a) to (d).

Let the amendment be carried out within a period of six weeks from today and copy of the amended petition be served on the parties. 6.
