The learned Addl.GP makes a statement, on instructions, that the advertisement issued for recruiting the candidates for the PAP category is by virtue of the following orders/judgment :

(a) The judgment dated 29th October, 2015 delivered by the Division Bench of this Court, at the Aurangabad Bench, in Writ Petition No. 1330 of 2014 (Ashok s/o. Manikrao Shinde & Ors. Versus The State of Maharashtra & Ors.) and another connected Writ Petition;

(b) The order of the Hon'ble Supreme Court dated 18th April, 2023 passed in Petition for Special Leave to Appeal (Civil) Nos. 17597/17600 of 2017;

(c) The order dated 9th May, 2024 passed by the Division Bench of this Court, at the Nagpur Bench, in Writ Petition No. 2333 of 2023 (Purushottam Sadashiv Kothale and Others Versus State of Maharashtra & Ors.) ;

(d) The order dated 30th July, 2024 passed by the Division Bench of this Court, at the Nagpur Bench, in Writ Petition No. 2333 of 2023 (Purushottam Sadashiv Kothale and Others Versus State of Maharashtra & Ors.) .

It is informed that pursuant to the aforesaid orders/ judgment, that the Government Resolution dated 14th October, 2024 has been issued and now the recruitment procedure for recruiting the candidates from the PAP category in the Agricultural Universities, has been started.

The learned Addl.GP specifically submits, on written instructions dated 19th March, 2025 from Shri Umesh Chandiwade, Under Secretary, State of Maharashtra, Departments of Agriculture, Animal Husbandry, Dairy Development and Fisheries, vide which, he is instructed to make a statement that the aforesaid recruitment process is not in relation to the workers at issue, who are presently engaged as contractual employees and it is not that the aforesaid recruitment would be made by creating posts upon ouster of these workers.

In view of the above fact situation, the apprehension voiced by the Petitioner in the Interim Application is put to rest and the Interim Application is, therefore, disposed off. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.)
