1. This is an application seeking modification of the order dated 27th June 2019 passed by this Court. The applicant has prayed that order be modified to include a specific direction to respondentmanagement to pay to the applicant gratuity payable to the applicant under the Payment of Gratuity Act as and by way of post retirement benefit and in accordance with the pay scale revisions which came into effect from time to time. The order passed by this Court is very specific.

LSP 2 6 ia 3812.25.doc 2.

It is not possible for us in this application to grant reliefs prayed for. If at all the applicant is entitled to gratuity, it is open for the applicant to approach the Competent Authority by making a claim for gratuity. If such a claim is made, the same will obviously be considered on its own merits and in accordance with law. 3.

With this clarification, the application disposed of. (S.M.MODAK,J.) (M.S.KARNIK, J.)
