The matter is taken on board by way of praecipe. This Court as per the order dated 23rd June 2025 has permitted the Applicants to withdraw 50% of the amount along with accrued interest on undertaking.

While admitting the Appeal on 19th March 2025, the Record and Proceeding was called and now it is received by this Court. The Applicants are facing difficulty in getting the withdrawal. It is for the Satish Sangar 1/2
P-2-IA-6543-2025-IN-FA-710-2025.doc reason, the Record and Proceeding is not with the Tribunal. The Tribunal is right because the Tribunal may be interested in knowing the final order and apportionment, if any, passed while delivering the judgment. In that case, let the Applicants / Claimants to annex copy of Award before the Tribunal. Inspite of this, if the Tribunal is insisting on the Record and Proceeding, the Tribunal to pass a judicial order and in that case, the Applicants are at liberty to move this Court for sending the Record and Proceeding.
