Interim Application has been preferred seeking recall of the order of 28th January, 2025 to the extent that will directs the dismissal of the Appeal for not taking appropriate steps against the deceased Respondent within a period of two weeks. 2.

Learned Counsel appearing for the Applicant submits that as the sole Respondent had expired appropriate Interim Application was taken out by Applicant however inadvertently the same came to be filed in the Second Appeal having the same name and it is only when the same was rejected that it came to the notice of the Advocate for Applicant. He submits that in Interim Application No. 6599 of 2025 has been taken out from bringing on record the legal heirs of proposed Shubham Talle 1 of

As the Interim Application has already been taken out, the steps as directed by order of 28th January, 2025 has been taken by Applicant and therefore the order of dismissal of the Appeal for failing to take steps within prescribed period stands recalled. The First Appeal is restored to file.
