Learned Counsel appearing for the Appellant submits that due to work commitment, Appellant was required to travel out of town and therefore was unable to give timely instructions to his Advocate for filing Appeal and by reason thereof there is delay of 33 days. 3.

Learned Counsel appearing for the Respondent does not seriously oppose the Application considering short duration. 4.

For the reasons stated in the Application, delay of 33 days is condoned and the Application is allowed.
