Initially the Applicant/Appellant has taken exception to this order by filing a writ petition. It was also disposed of as not maintainable.

There is a delay in filing an appeal. That is why, the present application. Though the Court notice service report is not received, the Applicant claims that private notice is served and affidavit is filed. 6.

One of the reason for condonation is ailment of the Applicant. He intends to produce supporting medical documents. 7.
