The Petitioners/Applicants moved this Interim Application in the light of the order of this Court, dated 11th March, 2025, which is evident of the fact that any further decision in the Writ Petition, post amendment, is likely to affect those Unions who have been accepted by Railways as representative Unions in a
recently held election on 6th December, 2024, results of which were declared on 12th December, 2024.

Mr. Chavan, the learned Advocate for the Railways, opposes the Interim Application.

We find that the Interim Application is justifiably filed. If this Court comes to a conclusion to grant any relief to the Petitioners, those Unions who succeeded in the elections, are likely to be affected by the verdict of this Court.

In such a situation, either the Petition would suffer for non-joinder of the parties or that an order accepting the claim of the Petitioners, would affect the rights of those Unions who have succeeded in the elections, without hearing them. 5.
Considering the above, this Interim Application is allowed. Addition be carried out forthwith.
ORDER BELOW WRIT PETITION NO. 16748 OF 2024 Considering the order passed in the Interim Application, issue notice to the newly added Respondents, returnable on 23rd April,2025.
