The above Interim Application is filed seeking a stay to the operation, execution and implementation of the Judgment and Award dated 24th March 2021 passed by the learned Civil Judge, Senior Division, Panvel, Dist. Raigad in L.A.R. No. 32 of 2014.

Mr. Patil, the learned Addl. G.P. appearing on behalf of the Applicant - State submitted that the Applicant had deposited the entire decretal amount with the Reference Court. He, therefore, requested for stay of the operation, execution and implementation of the impugned Judgment and Award dated 24th March 2021.

Considering that the entire amount has been deposited before the Trial Court, we allow the above Interim Application in terms of prayer clause (b), which reads thus :- "(b) that this Hon'ble Court be pleased to stay the execution, operation and implementation of the Judgment and Award dated 24.03.2021 passed by the Learned Joint Civil Judge, Senior Division, Panvel, Raigad in L.A.R. No. 32 of 2014 till the hearing and final disposal of the abovementioned First Appeal;" 4.

We further clarify that if any of the parties, by virtue of any orders passed by this Court, have been permitted to withdraw any amount deposited with the Reference Court, this Order will not come in the way of such withdrawal.

The Interim Application is disposed of in the aforesaid terms. However, there shall be no order as to costs. 6.
