______________________________________________________________ Mr. Bhavik Lalan a/w Viraj Bansod i/b Tushar Goradia, for the Applicant.

Dr. Yusuf Iqbal Yusuf, Neville Majra, Mustafa Chitalwala i/b Mangesh Naik, for Respondent Nos.4 & 5.

Mr. Sanjay D. Rayrikar, AGP, for the Respondent - State. _______________________________________________________________ CORAM: MADHAV J. JAMDAR, J.

DATED: 28 APRIL 2025 P.C.:

1.

The relief sought in the Interim Application is modification of the Order dated 3rd March 2025 by directing Respondent Nos.4 and 5 to repay the excess amount of Rs.1,67,000/- to the Applicant. 2.

However, learned Counsel appearing for Respondent Nos.4 and 5 points out Paragraph No.7 of the Order dated 3rd March 2025, which reads as under :-

16-IA-7005-2025.doc "7.

It is clarified that the Petitioner can take out proceedings for recovery of amount which according to him is due and payable to him by the Respondent Nos.4 and 5. The contentions in that regard are expressly kept open." 3.

Learned Counsel states that the said contention was raised earlier and therefore Court has directed as above.

4.

Accordingly, there is no substance in the Interim Application. The Interim Application is dismissed, however, with no order as to costs. [MADHAV J. JAMDAR, J.]
