By this application, the applicants are seeking to amend the cause-title of the first appeal by deleting the name of respondent No.3. 3.

It is contention of learned counsel for the applicants that the legal heirs of respondent No.3 are already on record. Hence, this application be allowed and the applicants be permitted to delete respondent No.3 from the cause-title of the appeal. Considering the submissions of learned counsel for the applicants and learned counsel for respondent No.1, the application is allowed in terms of prayer clauses (A) and (B) and disposed of. 5.

Necessary amendment be carried out within six weeks from today.
