Interim Application has been preferred for bringing on record the legal heirs of the deceased-Appellant No. 1 and for condonation of delay and for setting aside the abatement.

Mr. Patil, learned AGP does not seriously oppose the Application. 3.

The First Appeal is of the year 1999 and has already been admitted. The Appellant No. 1 expired during the pendency of Appeal. As the legal heirs were unaware that the necessary Application has to be moved for being impleaded in the proceedings, the Application Sairaj 1 of

120 Ia-7477-2025.doc could not be filed and thus, there is delay of 22 years and 232 days caused in preferring the present Application. 4.

The explanation tendered is sufficient for condoning the delay and hence, the same stands condoned and abatement is set aside. 5.

Interim Application is allowed.

Amendment to be carried out within a period of four weeks from today.
