Learned counsel for the appellant submits that on administrative grounds, the delay has been caused which is not deliberate.

Learned counsel for respondents/original claimants opposed the applicant on the ground that the delay is over 300 days. Length of delay is immaterial, the question is as to whether the appellant is in position to explain the same satisfactorily and any mala fide can SHUBHADA SHANKAR KADAM be attributed to the appellant.

For the reasons mentioned in the application, it cannot be said that the delay is intentional. No mala fides can be attributed to the applicant. Hence, the application stands allowed. The delay stands condoned.
