DATE : 29 SEPTEMBER, 2025 P.C. :- 1) This interim application is filed by the Acquiring body seeking stay to the Judgment and Award dated 29 February, 2024 passed by the Joint Civil Judge, Senior Division, Alibag in Land Acquisition Reference No. 19 of 2014.

2) Mr. Chawan, learned Senior Advocate for the applicant has tendered a chart showing that an amount of Rs.1,26,04,021/- has been deposited by cheque dated on 22 July, 2025.

KVM 2/2 32-IA-8232-2025.doc 3) Ms.Punde, learned advocate appearing for the original claimant submitted that in the present proceedings, the amount has not been withdrawn by the original claimants. She seeks liberty to permit the original claimants to withdraw 50% of the amount on usual undertaking. The original claimants are permitted to prefer an application before the Reference Court for withdrawal of the amount as per the usual undertaking.

4) The Reference Court would consider the withdrawal of the 50% of the amount alongwith accrued interest and the balance amount will be kept in Fixed Deposit.

5) In view of the same, this interim application is allowed in terms of prayer clause (a).
