At the outset it is stated that notice of today's hearing and urgent paper production is given to the advocate for the Respondent No. 5 - Adv. Amol Patil. Statement accepted.

It is submitted that on the said date, learned Counsel for the Respondent No. 5 sought time to file reply and had submitted that the Respondent No. 5 will not proceed with the Application of withdrawal of the amount before the next date. It is submitted that by mistake, it is recorded in paragraph no. 3 of the order that the statement is made on behalf of the Applicant/Appellant.

Learned Counsel for the Appellant pointed out that the Appellant is not held entitled to any amount of compensation and therefore there is no question of making such submission and it is obviously an inadvertent error. 5.

Perused the order dated 02/01/2020 under which the present Respondent No. 5 is held entitled to certain amount. It appears that this amount is sought to be realized at the instance of the Respondent No. 5. 6.

Since nobody is appearing for Respondent No. 5, statement can not be extended. It is therefore directed that till the next date, Respondent No. 5 shall not proceed with the Application of withdrawal of amount. (M. M. SATHAYE, J.) akn 2/2
