This Application is filed by the Applicant father seeking directions to permit the Applicant to have overnight access to Krisha from 23.06.2025 to 06.07.2025 (both days inclusive), during her ongoing summer vacation. The advocate Mr.Allwin Shrisunder who proposes to cause appearance for the Respondent submits that he has received instructions to appear for the Respondent. 2/3 908 ia 9036 of 2025.doc According to the advocate for the Applicant, the vacation of Krisha has commenced from 25.05.2025 and it would last upto 07.07.2025. Already the Respondent has enjoyed her share vacation days with Krisha. Therefore, the Applicant would like to spent rest of the vacation days with Krisha.
The Applicant relies on the previous orders passed by this Court on 03.07.2024, during which there was a weekend access granted to the Applicant. Thereafter, vide order dated 02.08.2024, the Respondent had given her consent and permitted the child for an overnight holiday stay at Lonawala from 17.08.2024 to 19.08.2024, and accordingly an agreement was arrived at between the parties and directions were issued by this Court to avail the access for that weekend i.e. on 17.08.2024. In the meanwhile, the Mediation was resorted to by the parties. It is informed that the Mediator has submitted the report, as yet it is not placed on record. According to the Respondent now very few days of vacation of the child Krisha remains, therefore she is pressing for an urgent order for grant of prayer in her favour. The advocate for the Respondent makes a request that the matter may be heard after grant of short adjournment, so that he can file his Vakalatnama. In view of the request of learned counsel for Respondent, and also considering that the Applicant has already been allowed a
3/3 908 ia 9036 of 2025.doc weekend access by orders passed by this Court, it would be appropriate to grant extended weekend access upto 26.06.2025 to the Applicant, till further consideration of application by way of interim arrangement.
