This application is taken out by the appellant inter alia for restoration of dismissal of the appeal for non-filing the paper-book as directed by order dated 10 July 2023 by which the appeal came to be admitted.

The reason for the delay in filing the paper-book was on account of old age of the appellant.

I have perused the application and being satisfied therewith, the delay in filing the present application is condoned as well as the first appeal is restored subject to the applicant-appellant filing paper-book within twelve weeks from today. If the paper-book is not filed within twelve weeks, then the appeal will stand dismissed without recourse to the Court and no further application for restoration of the appeal will be entertained.

It is made clear that the notice for which the stay is sought is not stayed by this Court.
