These two Interim Applications are filed for condonation of delay. The husband had filed a petition for divorce, while the wife had filed a petition for restitution of conjugal rights. Both petitions were heard together and were dismissed by a common Judgment and Order dated 15.10.2024. The said Judgment and Order is under challenge by way of two separate Appeals, in which, there is a delay of 115 days and 180 days, respectively.

2/2 26 IA.9221.2025.odt The learned counsel for the respective parties give their consent for condonation of delay in the respective Appeals. In view of the consent so given, the delay occurring in filing both the Appeals is hereby condoned. Accordingly, the Appeals shall be registered.

The learned counsel for the respective parties submit that the parties are willing to explore the possibility of settling their dispute through mediation.
In view thereof, the parties agree to be referred to the former Judge of this Court, Justice Shalini Phansalkar Joshi, who is requested to act as the Mediator.
It is submitted that the husband is presently residing in the USA and shall, therefore, participate in the mediation proceedings through V.C.
The learned Mediator is at liberty to settle the date of mediation, as per her convenience.
The learned Mediator is requested to submit her report within a period of eight weeks from the date of the first meeting.
The learned counsel appearing for the husband in Family Court Appeal (Stamp) No. 14113 of 2025 undertakes to inform the learned Mediator about her appointment and to take further necessary steps.
The Appeal memos shall be exchanged between the parties.
List the matter on 17.04.2026.
