This Interim Application is taken out for bringing on record the legal heirs of deceased Appellant No.1-A. Deceased Appellant No.1-A passed away on 23rd April 2017. There is delay in filing the application.

It is the contention of Ms. Kashvi Ail, learned Counsel appearing for the Applicants that other Appellants are her heirs and they are already on record.

It is her further submission that the Appellant No.1-B passed away on 20th January 2008 and leave be granted to bring on record heirs of the Appellant No.1(b) i.e. Applicant Nos.1-B(i) to 1-B(iii). As far as delay is concerned, she submits that delay has been explained in paragraph Nos.5, 6 and 7 of the Interim Application. She states that therefore, delay be condoned. 4.

On the other hand, Mr. Suralkar, learned Counsel appearing for the Respondents strongly opposes the Interim Application. He submits that the Interim Application be dismissed. 5.

However, for the reasons set out in the Interim Application, the same is allowed in terms of prayer clauses (a), (b) and (c). 6.

Amendment be carried out within a period of 14 days from today. Amended copy of the Second Appeal be served on the Respondents within the said period of 14 days. 7.

The Interim Application is disposed of in above terms with no order as to costs.
