This Review Petition is filed praying for review of the judgment and order dated 5th January, 2024 passed by a co-ordinate Bench of this Court of which one of us Justice Arif S. Doctor was a member. Such judgment and order passed in the Writ Petition was challenged before the Supreme Court in the proceedings of SLP No. (s) 5818 of 2024, however, it was rejected by the Supreme Court vide an order dated 15th March, 2024. After this petition was heard for some time, Mr. Patil, on instructions of the Petitioner who is present in the Court seeks leave to withdraw this petition with liberty to the petitioner to pursue the petitioner's case on any fresh material with the M.I.D.C. It is open for the petitioners to do so as any such consideration was not part of the adjudication of the orders under review. All contentions of the parties in that regard are expressly kept open. 3.

In view of the disposal of Review Petition, Interim Application does not survive and accordingly stands disposed of.
