Heard learned Counsel for the Applicant and learned Counsel for the Respondent No.2.

This application is filed by Revision Applicant to delete the name of Respondent No.1 and substitute the Respondent No.2 in her place. It is the case of the Applicant that the during pendency of the revision application, Respondent No.1 has transferred the suit premises to Respondent No.2.

Learned Counsel for the Respondent No.2 however submits that Annexure-A relied upon by the Applicant shows that by registered document dated 29.10.2007, the rights were acquired by Respondent No.2 and the said event has not taken place during the pendency of revision application, but prior to it.

Perusal of the record shows that Respondent No.2 is already appearing as Respondent No.2 in Revision Application. In that view of Sneha Chavan 1/2

24-IA-9724-2025.doc the matter, the Applicant can be permitted to delete Respondent No.1 at his risk.

The application is accordingly partly allowed. The Applicant is permitted to delete the name of Respondent No.1 from the array of Civil Revision Application. The deletion shall be at the risk of the Applicant. 6.

Amendment to be carried out within a period of 2 weeks from today.
