Heard learned Counsel for the parties. This is an application by the State for restoration of the First Appeal, which was dismissed under conditional Order dated 03.01.2023 for non filing of paper book within stipulated time. There is delay in filing application. 2.

Learned Additional Government Pleader states that the paper book is now ready and can be filed if permitted. Learned Counsel for the Respondents submits that cross objections are already filed in the matter.

Considering the averments in the application, nature of dispute, and that substantive appeal was dismissed on technical reason and further that the paper book is now ready, sufficient cause is made Sneha Chavan 1/2

(a) Subject to condition of Applicant/State filing paper book within a period of 4 weeks from today, delay if any is condoned, the dismissal under conditional order is set aside and the Appeal is restored to file.
