The Applicant/Petitioner is challenging the order dated 28.04.2025, whereby the present Writ Petition was dismissed for non prosecution. On 28.04.2025 as none appeared for the Petitioner in the morning Session, the matter was kept back in the afternoon Session, but, in the afternoon Session also the Petitioner, was absent because of the unavoidable circumstances. The learned counsel for the Applicant submits that since he was on his legs before another Court, he could not RAJESHRI PRAKASH AHER attend the matter.

Though there is a delay in filing the present Application, however, it is unintentional, the Applicant is not going to gain anything by causing delay. In view of the explanation given by the Applicant, the order dated 28.04.2025, is recalled by condoning the delay and the Writ Petition is restored to its original file.
