Heard learned Advocate for the Applicants/Plaintiffs. Their suit was dismissed by the City Civil Court - Dindoshi on 26th September 2024. There is a delay of 64 days in preferring the Appeal. It is Satish Sangar 1/2
16-IA-10215-2025+IA-10216-2025-IN-FA(ST)-14077-2025.doc opposed on behalf of the MCGM by filing Affidavit-in-Reply. The Applicant No.1 - Teertha stays at Dubai. Even the Applicants intended to engage a new Advocate. Hence more time was consumed for taking instructions and for giving instruction to the new Advocate. Even the earlier Advocate was under impression that 90 days' is the period for filing an Appeal but in fact it is 30 days. I find those details as sufficient reasons. Hence the Application is allowed in terms of prayer clause (a). It is disposed of.
