This Court decided the Petition No.6578 of 2016 vide order dated 18th July 2025.

It is the submission of Learned Counsel for the Applicant/Petitioner that Paragraph No.9 of the said order dated 18th July 2025 records that the termination of the Petitioner will remain, but subject to the outcome of the proceedings before the Scrutiny Committee. It is now brought to our notice by Learned Counsel for the Applicant/Respondent that the Petitioner was reinstated in service and was in service on 18th July 2025, MMP

2 911-IA 10608-25.doc when the Writ Petition came to be decided. In this view, Learned Counsel for the Applicant/Petitioner prays for deletion of said Paragraph No.9. 3.

Hence, the order dated 18th July 2025 stands corrected to the extent that Paragraph No.9 be deleted and shall now be substituted with the following Paragraph:- "9. The Petitioner shall be continued in service subject to the outcome of the proceedings before the Scrutiny Committee."

The Interim Application is disposed of in the aforesaid terms. 5.

It is made clear that the claim for back wages for the period when the Petitioner was terminated till he is reinstated is kept open and is to be decided after the decision is taken by the Scrutiny Committee in the appropriate proceedings.
