This appeal is filed by the defendant to challenge the adinterim order passed in favour of the plaintiff by the City Civil Court. By order dated 31st July 2025, this court stayed the impugned order. 2.

Learned counsel for the respondent(plaintiff) on instructions seeks leave to withdraw the Special Civil Suit No. 1671 of 2025 with liberty to file an appropriate proceeding before the Competition Commission under the Competition Act, 2002.

Leave granted, with liberty as prayed.

The Special Civil Suit No. 1671 of 2025 is disposed of as withdrawn with liberty to the plaintiff to file appropriate proceedings as permissible in law under the Competition Act, 2002. 5.

In view of the withdrawal of the suit, this appeal is disposed of as infructuous.

It is clarified that the impugned order dated 29th July 2025, passed in Special Civil Suit No. 1671 of 2025, stands vacated. 7.

All rival contentions of the parties on merits are kept open. 8.

Appeal is disposed of in the aforesaid terms. In view of disposal of the appeal, the pending applications are disposed of as infructuous.
