Mr. Punde, appearing for the original claimant submits that the law as far as amendment of a claim in a Land Acquisition matter is concerned is settled. The same can be amended even at an Appellate Stage.

He refers to the Judgment of Supreme Court in case of Ambya Kalya Mhatre (DEAD) Through Lrs. And Others Vs. State of Maharashtra reported in (2011) 9 Supreme Court Cases 325. Sharada

Considering the law as laid down by the Supreme Court in above Judgment Ambya Kalya Mhatre Vs. State of Maharashtra (supra) and after hearing the submissions made by Mr. Punde and Mr. Patil according to me, a case is made out to allow the Interim Application.

The Interim Application is allowed in terms of prayer clause (A).

Amendment to be carried out within a period of two weeks from today.

The Applicant is also permitted to pay the deficit Court Fees within 4 weeks from today.
