Heard learned Advocate Shri Keni for the Appellant and learned Advocate Mr. More for the Respondent-Claimant. 2.

There is a case put up before the Labour Commissioner that deceased was in the bus of the Appellant. Whereas, it was disputed by the Appellant. According to him, twin test is not satisfied and the connection of the relationship and death is not established. This issue goes to the root of the matter. Hence instead of deciding withdrawal application, it is decided to hear the appeal finally. 3.

The Appellant to file compilation of the documents within two weeks. They can exchange the judgments amongst them. 4.
