Mr. Patil, learned advocate appears for respondents and seeks accommodation to file affidavit-in-reply. 2.
Present application is filed to recall order dated 21st July 2000 in Second Appeal No.437 of 1990 and order dated 15th July 2022 passed by this Court in Interim Application No. 9 of 2022 in Second Appeal No. 437 of 1990 and seeks restoration of second appeal which has been dismissed for non-removal of office objections.

It appears that second appeal was admitted on substantial questions of law and has been dismissed for non-removal of office objections.

Mr. Dalvi, learned advocate appearing for applicant, informs that in pursuance of decree which is subject matter of second appeal, possession warrant is issued and applicant is likely to lose possession.

In that view of the matter, till next date of hearing, execution and implementation of possession warrant, if any, be kept in abeyance.
