Learned counsel for the Respondent raises an objection that the 25% penalty which was awarded has not been deposited by the Appellant, and hence, the Appeal cannot be entertained unless the entire amount has been deposited.

Learned counsel for the Applicant submits that within a period of four weeks, the amount will be deposited. The said statement is accepted as undertaking given to this Court.
