Heard Mr. Sawant, learned Advocate for Applicant - Org. Petitioner.

Present Interim Application seeks revival of Contempt Petition No. 173 of 2019 which came to be disposed of by this Court by passing the following order on 23.09.2024:- "1) Mr. Gole, the learned counsel appearing for the Respondent places on record affidavit to which office order dated 20 September 2024 is appended.

2) Perusal of the said office order would indicate substantial compliance with the order passed by this Court. 3) The Contempt Petition is accordingly closed.

4) However, in the event there is any delay on the part of the Respondent in paying the amount of arrears, the Petitioner would be at liberty to move this Court once again."

Mr. Sawant would draw my attention to paragraph No. 1 of the above order and submit that the substantive order dated 20.09.2024

907. IA-10956-25.docx referred therein is appended at page Nos. 35-36 of the Petition. He would submit that there are certain difficulties in respect of the said order and therefore the Contempt Petition should be revived. 3.

I disagree with the submissions made by Mr. Sawant in view of the fact that as noted by my learned predecessor (Coram : Sandeep V. Marne, J.) in the order dated 23.09.2024 that as there is substantial compliance with the order passed by this Court by virtue of the office order dated 20.09.2024, the Contempt Petition is closed. There is no challenge maintained to the said order by the Applicant. Neither the present Application is in the nature of review in respect of the order passed by this Court previously. If the Applicant is aggrieved due to any reasons, it shall be open to the Applicant to take appropriate steps as available to the Applicant in law including filing of Contempt Petition if there is non-compliance of any order, if so necessary in accordance with law.

With the above directions, present Interim Application is disposed.
