The Applicants have filed this application for condonation of delay of 40 days in filing Second Appeal. The counsel for Applicants has stated that though the appeal was filed within limitation by way of e-filing, due to technical difficulty some objections were raised as the certified copy was not filed alongwith said Memorandum of Appeal and, therefore, it was considered that the appeal was not filed within stipulated period and, therefore, the applicant has filed this application for condonation of delay of 40 days. Considering the reasons given in the application that due to technical difficulty, it is considered by the office that the Appeal is not filed within limitation, the Application is allowed. The delay, if any, is condoned.
