Heard learned Advocate for the Applicant and learned Advocate for the Respondent Nos. 1 and 2. Respondents are the Claimants. They appeared and file affidavit-in-reply thereby opposing the delay. According to them, departmental lethargy, red-tapism and internal by SEEMA KSHITIJ YELKAR Date:

procedures cannot be treated as "sufficient cause". The judgment is delivered by Railway Claims Tribunal on 29.08.2024. The certified copies are received on 07/10/2024. The Applicant is Union of India through Railway department. I have perused the ground nos. 2 and 3 of the application. It talks about completion of the office procedure. It cannot be considered as departmental lethargy. The Applicant is not individual litigant. They are not contesting in individual capacity certain procedure has to be complied with.

I am satisfied with the reason for condonation of delay. It is 44 days. Hence, Interim Application No. 11134 of 2025 is allowed in terms of prayer clause 'a'. It is disposed of. FIRST APPEAL (ST) NO. 24042 OF 2025 3.

Issue notice to the Respondents. Learned Advocate Shri Khandeparkar waives notice for Respondent Nos. 1 and 2. A copy of the memo of appeal be served on learned Advocate for the Respondents.

Stand over to 10th November 2025.

INTERIM APPLICATION NO. 11135 OF 2025 5.

Stay is granted to the execution of the Award dated 29.08.2024 2/3

passed by the learned Member (Judicial), Railway Claims Tribunal, Mumbai subject to deposit of the entire amount within a period of four weeks before Railway Claims Tribunal, Mumbai. 6.
