The Petitioner has filed this Application to bring on record the legal heirs of Respondent No.3 and Respondent No.3A. It is noted that there is a delay of eight years in filing the Application for bringing the legal heirs on record.

The learned counsel appearing for the Petitioner has stated that this Petition was admitted in the year 2014. Thereafter, the matter was not listed on board, and upon transfer of this matter from the Suresh 1/2

929-IA-11158-2025.doc Principal Seat at Mumbai to the Circuit Bench at Kolhapur, the learned counsel, while taking steps to serve the Respondents, came to know about the death of Respondent No.3, which has contributed to the delay.

Considering the reasons given by the Applicant, the delay is condoned. The Petitioner is permitted to bring the legal heirs of Respondent No.3 on record.

It is further noted that during the pendency of this Application, Respondent No.3A also died on 8th September 2025. The Application to bring the legal heirs of Respondent No.3A has been filed within the period of limitation of 90 days. Accordingly, the Petitioner is permitted to bring the legal heirs of Respondent No.3A on record. 5.

The Application is allowed. The Petitioner is directed to bring the legal heirs of Respondent Nos.3 and 3A on record within a period of one week.

Stand over to 20th February 2026.
