The delay of 195 days in filing the present appeal has been explained in paragraph No. 3 of the interim application. Upon considering the reasons stated therein, this Court finds that sufficient cause has been shown for the delay. Accordingly, the delay of 195 days in filing the appeal is condoned. 2.

In view of the above, the interim application deserves to be allowed. It is therefore allowed in terms of prayer clause (b). 3.

Accordingly, the interim application stands allowed and is disposed of.

The appellant shall prepare and file the paper book within a period of one year from today.

INTERIM APPLICATION NO. 11200 OF 2025 6.

By the present application, the applicant has challenged the judgment and award whereby compensation has been granted at the rate of Rs.2,000/- per square metre. Having considered the facts of the case, the nature of the challenge raised, and the grounds set out in the application, this Court is of the view that the applicant has made out a prima facie case for grant of interim protection during the pendency of the appeal. 7.

Accordingly, the application is allowed in terms of prayer clause (b), subject to the condition that the applicant shall deposit the entire awarded amount together with accrued interest before the Reference Court within a period of twelve weeks from today. 8.

It is clarified that if the aforesaid amount is not deposited within the stipulated period of twelve weeks, the interim protection granted by this Court shall automatically stand vacated without any further reference to the Court.

With the above directions, the interim application stands allowed and is disposed of.
