Interim Application has been preferred seeking condonation of delay of 53 days in filing the First Appeal.

Learned counsel for the Respondent-Corporation would seek time, however, considering that the Application has been served way back upon the Corporation and that the delay is only of 53 days, this Court is not inclined to grant any time for filing affidavit-in-reply. 3.
Learned counsel for the Applicant submits that the impugned Chavan 1 of
102-IA-11279-2025.doc judgment was passed on 15th April, 2025, and thereafter, due to the ensuing vacations, the office of the advocate was not fully functional. He would further submit that the litigation is way back of the year 2011 and voluminous documents had to be filed for the purpose of filing the Appeal which led to the delay.

Learned counsel for the Respondent-Corporation would submit that there is no sufficient explanation for the delay and the Applicants were well aware of the passing of the judgment and no indulgence ought to be shown.

The delay is of 53 days and it is not demonstrated that there was any negligence on part of the Applicant by reason of which delay has occasioned. On the contrary, Applicant has been diligently pursuing the matter which is evident from the fact that the litigation has continued over several years which has been actively pursued by the Applicant. 6.
In light of above, for the reasons stated in the application, delay stands condoned. Interim Application is allowed. FIRST APPEAL (ST) NO. 26855 OF 2025 7.
List the First Appeal on 12th March, 2026.
