The applicant, who is the defendant No.1 has filed the application in Civil Suit, which was filed by the plaintiff for declaration and partition and other reliefs. The application filed by the defendant under Order VII Rule 11 was rejected by the Trial Court. Hence, the defendant No.1 has filed this Civil Revision Application.

The counsel for applicant has stated that the applicant is suffering from cancer and due to which there is delay of 9 days. 4.

Considering reasons given in the application, the delay of 9 days is condoned. The application is allowed. 5.
