MANDIRA MILIND SALGAONKAR MILIND SALGAONKAR Date: 2026.03.16 17:26:04 +0530 CIVIL APPELLATE JURISDICTION INTERIM APPLICATION NO.11791 OF 2025 IN FAMILY COURT APPEAL NO.91 OF 2023 Prashant Bhaurao Ahire ..

Applicant

Versus

Sonali Prashant Ahire ..

Respondent ...

Mr.Mayur Vinod Faria with Mr.Harshal Hasmukh Savla for the Applicant.

Mr.Abhishek Kulkarni for the Respondent.

CORAM: BHARATI DANGRE & MANJUSHA DESHPANDE, JJ.

DATE : 13th MARCH, 2026 ...

P.C:- 1.

In a very strange way, the Interim Application filed by the Applicant-husband seeks restoration of the Family Court Appeal, which was disposed of by this Court, based on the Consent terms. It is urged before us that since there is a breach of conditions, subject to which the Family Court Appeal was disposed of, the Appeal itself shall be restored. 2.

We find the relief to be quite strange as a bond of good behaviour, though expected to be adhered to, will not permit the parties to restore the court proceedings, because there is a

2/2 13 IA-11791-25.odt breach. For this reason, we are not inclined to entertain the Interim Application, as if any fresh cause of action arises between the parties, the fresh proceedings are permitted to be filed under the provisions of law.

Hence, the Interim Application is dismissed.
