This application is for restoration of Writ Petition No.4503 of 2006, which was dismissed vide the order dated 04/07/2025. Learned counsel for the Applicant submitted that inadvertently he could not remain present before the Court on 04/07/2025. There was some miscommunication regarding the Digitally signed by MANUSHREE NESARIKAR Date:

2025.10.15 11:10:30 +0530 MANUSHREE NESARIKAR matter, which was listed and therefore, he did not reach the Nesarikar

2 / 3 Court when the matter was called out. Consequently, the Writ Petition was dismissed for non-prosecution.

Both the learned counsel appearing for the Respondents opposed this application. However, in the interest of justice, we are inclined to allow this application. 3.

Considering these submissions and in the interest of justice the the Application can be restored. It is also to be noted that the Writ Petition was originally admitted vide the order dated 11/08/2006 with the interim relief in the favour of the Applicant.

Hence, the following order :

O R D E R

(i) The Writ Petition No.4503 of 2006 is restored to its original file with restoration of the interim relief which was granted vide the order dated 11/08/2006.

(iii) Writ Petition to proceed in due course for final hearing.
