1.
The above Interim Application is filed seeking a clarification of the judgment and order dated 16th June 2025 passed in PIL No.211 of 2023 to the effect that the directions issued therein with
respect to Plot Nos.217 and 210 shall also extend to Plot No.209 which was part of the subject matter of the PIL and is reserved for beautification of the Israel Tank sanctioned development plan. 2.
As far as this issue is concerned, we have heard the learned advocate appearing on behalf of the Applicant, as well as the learned advocate appearing on behalf of the Panvel Municipal Corporation. We also perused the order dated 16th June 2025. After perusing the said order, we find that though a reference was made to Plot No.209 in the said order as well as in the pleadings in the PIL Petition, a reference to the same has been missed out in the operative part of the judgment. It is accordingly clarified that the directions given in paragraph 8 of the judgment dated 16th June 2025 shall also apply to Plot No.209 in addition to Plot Nos.217 and 210. Since we have included Plot No.209 today by virtue of this clarification, the exercise that needs to be carried out as per paragraph 8 of the order dated 16th June 2025 is extended by a period of 3 months from today.
3.
As far as other reliefs sought in the above Interim Application are concerned, we are afraid the same cannot be granted in this Interim Application which merely seeks a clarification of the order
dated 16th June 2025. If for any reason the PIL Petitioner is of the view that the directions are not carried out by the concerned Municipal Corporation in letter and spirit, it is free to adopt appropriate proceedings in relation thereto.
4.
The Interim Application is disposed of in the aforesaid terms. However, there shall be no order as to costs. 5.
